Yahoo and google in lawsuit around online casinos

A California Superior Court Judge recently dismissed a lawsuit brought against search engine heavyweights Yahoo and Google.  The suit was filed by online gamblers who had suffered heavy losses.  They argued that companies who accept adverts for online gambling should be held liable for damages or losses casued by using the sites. However, the Judge ruled that the Communications Decency Act excuses ISPs from liability caused by the words or actions of third parties that use their service. In other words, despite the fact that both Yahoo and Google used to run ads for online casinos, (which neither any longer does) they cannot be held responsible for the actions of the casinos or gamers who use them.

A victory then, for common sense and a pleasant change for the online gaming industry which had been gainng something of a persecution complex, due to the number of ambivalent and outdated charges filed against it by federal prosecutors.

However, the Communications Decency Act does not offer protection from the criminal laws of the federal government, as Google, Yahoo and Microsoft recently discovered to their cost – they were fined a total of $31.5 million by the US Justice Dept. for promoting illegal online gambling sites…
